Terms of Service

These terms govern your use of Lightdrift, the image search API and dashboard at lightdrift.ai (the “Service”), operated by Ondara, LLC, a North Carolina limited liability company doing business as Lightdrift (“we”, “us”). By creating an account or using an API key you agree to them.
1. Beta service
The Service is in beta. Features, limits, pricing and availability may change, and the Service may be interrupted or changed without notice. We may end the beta or your access to it at any time. During the beta, the first request after a period of inactivity can take noticeably longer while our systems start up.
2. Accounts and API keys
You must be at least 18 and provide accurate account information. API keys identify your account: keep them secret, do not share them, and rotate any key you believe has been exposed. You are responsible for all use under your keys, including use by any software or agents you run.
3. Credits and payment
The Service is prepaid. You buy credit in US dollars and each API request that performs a search deducts the price shown in the dashboard at the time of the request. Promotional credit we grant has no cash value and expires when we say so. Purchased credit is non-refundable except where the law requires otherwise or where we decide, at our discretion, to refund a charge. Payments are processed by Stripe; we do not store card numbers.
4. Usage limits
Each API key has request-rate and concurrency limits, which depend on your account tier and are returned in the response headers of every request. We may lower limits or suspend keys that harm the Service or other customers, including abusive request patterns, attempts to bypass limits, or scraping of the catalog.
5. Images and rights information
The Service returns links to images hosted by third parties together with the licence and attribution information those sources declare. We do not own the images and we do not verify rights beyond what the source declares. Rights information is provided “as declared by the source” on a best-effort basis. You are responsible for confirming that your use of any image complies with its licence and applicable law, including any attribution the licence requires. We may remove images or sources at any time, including on request from a rights holder.
6. Acceptable use
You agree not to use the Service to:
- violate any law or the rights of others;
- build a competing catalog by bulk-extracting results or images;
- circumvent authentication, rate limits, or billing;
- send content that is unlawful or that you have no right to submit.
7. Your queries and our logs
We log requests, including query text, parameters, returned results and which results were fetched, to operate, secure and improve the Service, including improving ranking. See the Privacy Policy for details and retention.
8. Intellectual property
We own the Service, its software, documentation and branding. You own your queries and anything you build with the results, subject to the rights of the image sources. You grant us a licence to use your queries and usage data as described in the Privacy Policy.
9. Disclaimer and limitation of liability
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including accuracy of results or rights information, fitness for a particular purpose, or uninterrupted availability. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, and our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.
10. Indemnity
You will defend and indemnify us against claims arising from your use of the Service, your use of any image obtained through it, or your breach of these terms.
11. Termination
You can stop using the Service at any time and ask us to delete your account. We may suspend or terminate access for breach of these terms or to protect the Service. Sections 5, 8, 9, 10 and 12 survive termination.
12. Governing law and changes
These terms are governed by the laws of the State of North Carolina, United States, without regard to conflict-of-law rules, and disputes will be brought in the state or federal courts located in North Carolina. We may update these terms; material changes will be announced in the dashboard or by email, and continued use after the change means you accept it.
